■ Legal Nature of Administrative Rules and Whether They Are Binding Law: External Effect of Discretionary Guidelines, Competing Theories, Statute-Supplementing Rules and Case Law — Overview

A ten-page report that carefully sets out, through case law and academic theories, a long-standing issue in administrative law: whether administrative rules are binding legal norms that also have effect on citizens. The introduction starts from the point that any organization needs rules to function, and explains that administrative rules govern the inside of the administrative organization and special power relationships rather than relations with the general public, that the quasi-legal-norm theory is the prevailing view, and that such rules take effect through notification or posting once they meet the requirements of issuing authority, content, form and procedure.

The first chapter of the body defines administrative rules as general and abstract norms enacted as standards for handling affairs within the administrative organization, noting that in practice they go by names such as directives, established rules, guidelines and public notices, and summarizes the relevant provisions of the Regulations on the Operation of Legislative Affairs. The second chapter is the core. On discretionary guidelines issued in the form of administrative rules, it introduces the Supreme Court's position that a Minister of Transportation directive was merely hortatory, then compares the quasi-legal-norm theory, which recognizes an indirect external effect through the principle of equality and the doctrine of administrative self-binding; the legal-norm theory, based on special ordinances and on a dualist view that recognizes the executive's own legislative power; and the typology theory.

It then reviews case law and theories again, separately for rules with and without delegation in a statute, and summarizes the exceptional cases in which binding legal force is recognized. The third chapter draws an interim conclusion by synthesizing the theories and case law on whether administrative rules are binding law, and the conclusion points to the reality that the specialization of administration in a social welfare state leads to more administrative legislation, and to the problem that, because they are not binding law, violations of administrative rules do not raise questions of illegality and are excluded from judicial review.

It is well suited to assignments and exam preparation for the administrative legislation unit in general administrative law and administrative action classes. Because it quotes Supreme Court holdings directly throughout and marks key sentences with asterisks, it is convenient for reviewing only the important case-law principles right before an exam, and because it notes the criticisms of each theory, it also helps you practice setting opposing views against each other in an answer.

Imagine getting penalty points for breaking your university dormitory's rules, and the topic suddenly feels close. The rulebook is an internal document for running the dormitory, but if those points get you expelled from the dorm, the rulebook has directly affected your life. This report's debate over whether administrative rules are merely internal standards of the administration or law with effect on citizens deals with exactly that question in the language of administrative law.

I enjoy comparing the hierarchy of company regulations and statutes, but I remember being overwhelmed by the names of the theories when I first studied this unit, because the quasi-legal-norm, legal-norm and typology theories seem to say similar things slightly differently. By organizing case law and theories separately for cases with and without a delegating provision, this paper keeps you from getting lost about which reasoning applies in which situation.

What I noticed reading through the cases is that the courts have found a delicate balance: in principle they deny that administrative rules are binding law, yet they effectively recognize their binding force through the principle of equality and self-binding. The most confusing part of this unit is statute-supplementing administrative rules. If you separately note that public notices or directives that supplement the content of a higher statute under its delegation have external effect in combination with that statute, it will help a great deal in case-based questions.

그 뿐만 아니라 일정한 법규명령형식의 행정입법을 구태여 규정내용에 따라 행정명령적인 것이라 하여 그 법규성을 부인하는 것은 현대국가에 있어서의 법규관념의 확대와 특별권력관계의부정등에 따르는 행정명령의 비법규성에 대한 반성적 재검토와 법규성인정의 경향에 어긋나는 일이라 아니할 수 없다. 결국 교통부령인 이 규칙은 행정청 내부의 사무처리준칙을 정한 것에 불과하여 법규성을 가지지 아니한 것으로 본 판지에는 찬성하기 어렵다

필자로서는 소극설(행정규칙설)을 지지하려고 한다. 왜냐하면, 법규명령과 행정규칙의 구분기준은 1차적 징표로서는 형식적 기준에 의하나, 원칙적 구분기준은 행정규칙의 직접적·대외적효력설(=법규설)에 따라 "의회의 기능영역"인지 또는 "행정부의 기능영역"인지의 실질적 내용에 따라 분류할 것이기 때문이다. 따라서 행정규칙이 정할 사항은 원칙적으로 존재하며, 그것은 "법률유보에 해당하지 아니하는 사항"이라고 할 것이다.

다만, 우리 대법원 판례가 재량준칙에 대하여 원칙적으로 한결같이 대외적 효력을 부인하는 것은 잘못되었다고 보며, 필자는 직접적·대외적효력설에 따라 재량준칙의 경우에는 전형적인 '시원적인'(=위임·수권을 요하지 아니하는) 행정부의 법이 창조되며 이것은 직접적 대외적 효력을 가지되 예외적 경우에는 동준칙에서 일탈할 수 있는 완화된, 신축적 구속력을 가진다고 보고 있다.

이러한 논리는 우리의 법제(예를 들어 식품위생법)에서 "보건복지부장관, 시·도지사, 시장·군수·구청장은 영업자가 다음 각호의 1에 해당하는 때에는 영업허가의 전부 또는 일부를 취소하거나 6월이내의 기간을 정하여 영업을 정지하거나, 영업소의 폐쇄를 명할 수 있다"(제1항)라고 규정하여 행정관청에 대하여 재량을 인정한 후, "제1항의 규정에 의한 행정처분의 세부적인 기준은 그 위반행위의 유형과 위반의 정도 등을 참작하여 보건복지부령으로 정한다."(제4항)라고 규정하여 재량준칙을 법규명령(부령)의 형식으로 정하도록 한 경우에도 달라지는 것은 아니라고 생각된다.

즉, 제1항에서 행정관청에 대하여 재량을 인정하면서 제4항에서 재량준칙의 설정에 있어서 참작할 사항과 그 '법형식'을 특정한 경우에 있어서는 제1항에서 행정재량을 허용한 범위안에서는 원칙적으로 행정부에게 법률의 목적을 지향하는 행정자율적인 척도(재량준칙)의 수립권한이 주어져 있으며, 이 경우 행정부는 당해 법률을 집행함에 있어 개별적 경우의 특수여건을 고려할 수 있는 일정한 정도의 결정의 자유를 가진다고 할 것이다.

다만, 제4항의 규정에 의하여 당해 재량준칙의 수립에 있어서 참작할 사항("위반행위의 유형과 위반의 정도등")의 제한을 받게 될 뿐이며, 그 참작사항의 한도 안에서는 여전히 행정청에게는 재량준칙의 설정권한이 있게 되며, 이 경우 "보건사회부령으로 정한다"고 규정한 것은 "법정립권한의 수권·위임"이라기 보다는 "보건사회부장관"이 당해 재량준칙을 수립할 권한이 있음을 확인하는 것일 뿐이며 재량준칙이 법형식상 법규명령으로 정해지도록 법률에서 규정한다고 하여 그 재량준칙의 법적성질(행정규칙)이 바뀌는 것이라고 볼 수는 없다고 생각된다.

원칙은 법규성을 부정한다. 예외적으로 법규성을 인정하는 경우도 있다. 판례는 행정규칙의 법규성 인정 여부에 대하여 일관되지 않다. ★건설부장관 훈령인 ‘건축사사무소의등록취소및폐쇄처분에관한규정’: 청문절차를 거치지 않으면 위법하다.(대판1984) ★행정규칙 형식의 법규명령(법령보충규칙)의 경우에는 그 자체로서 직접적으로 대외적 구속력을 갖는 것이 아니라, 상위법령과 결합하여 일체가 되는 한도 내에서 상위법령의 일부가 됨으로써 비로소 대외적 구속력을 갖게 된다.

Basic concepts for understanding administrative rules and administrative legislation

Administrative legislation is the making of general and abstract norms by administrative agencies. It is divided into legislative orders, which set matters concerning citizens' rights and duties and are externally binding, and administrative rules, which set standards for handling affairs within the administrative organization. Legislative orders include presidential decrees, Prime Minister's ordinances and ministerial ordinances, while administrative rules are issued under names such as directives, established rules, guidelines and public notices.

Discretionary guidelines are administrative rules that set standards for an agency's exercise of discretion. They do not directly bind citizens themselves, but once an administrative practice following them has been repeated, the doctrine of administrative self-binding may apply, under which the principle of equality binds the agency to its own standard.

The Supreme Court holds that when a higher statute delegates specific matters to be set in the form of administrative rules, those rules, in combination with the higher statute, have effect as externally binding legislative orders. These are called statute-supplementing administrative rules.

If administrative rules are regarded as not having binding legal force, violating them alone is not illegal, so they easily escape judicial review. For that reason, constitutional complaints, supervision by higher agencies and parliamentary control of administrative legislation are also discussed as means of controlling administrative rules.
