Workers in Special Types of Employment and Industrial Accident Insurance: Concept, Current Status, Application of the IACI Act, Problems and Improvements

An eight-page report on workers in special types of employment, who sit on the boundary between employees and the self-employed: their concept and current status, how the Industrial Accident Compensation Insurance (IACI) Act applies to them, its problems, and proposed improvements. Drawing on ten references, the discussion cites statutory provisions alongside statistics. The opening section first explains the concept of an employee under the Labor Standards Act, then shows how the courts' test shifted from 'specific and direct direction and supervision' to 'considerable direction and supervision', leading to a broader interpretation of employee status.
It also summarizes how this form of employment emerged from the mid-1980s and the figure of about 635,000 such workers counted in the 2007 Statistics Korea supplementary survey. Next, it explains how the special provisions of industrial accident insurance applied only to certain occupations, such as insurance agents, concrete mixer truck drivers, home-study tutors, golf caddies and parcel delivery workers, with premiums split equally between the business owner and the worker.
As problems, it points to the limited list of covered occupations and to equity issues in light of Article 34 of the Constitution; as improvements, it proposes revising the relevant provisions, building a protection framework, publicly announcing standard amounts, and setting independent criteria for recognizing occupational injuries. The conclusion stresses that these workers are no longer an unusual group but people we meet every day.
Whenever I saw news of a delivery driver or a designated driver getting hurt on the job, I wondered how their industrial accident claims were handled. This report helped me understand that because the law designated occupations one by one, gaps were inevitable. Comparing how the equal premium split differs from the arrangement for ordinary employees made the issues especially clear. Its improvements are organized into four strands, which also helps when writing a conclusion.
The statistics and provisions reflect the situation around 2010, so reading them side by side with the current law, which switched to the 'labor service provider' system in 2023, will make the changes easier to see.
앞서 말한 것처럼 위의 법은 표면적으로는 많은 사람들을 돕고 있는 것으로 보인다. 그러나 실제로는 그 내용이 상당한 부담으로 다가오게 되는데, 이 경우에 발생할 수 있는 문제에 대해서 해결방법이 필요한 것이다. 즉, 임의 가입규정을 삭제함으로써 강제가입의 원칙을 특수형태근로종사자의 보험관계에도 관철시키는 내용으로 관련 법령을 개정하는 방법이 있을 것이다.
즉, 재정적인 부담을 통하여 보험을 가입할지에 대한 여부를 고민하지 못하도록 사전에 차단하는 효과도 있을 것으로 보여진다. 사실상 산재보험의 경우에는 사용자에 의한 책임보험의 성격과 함께 사회보장적인 성격을 가지고 있는데, 특수형태근로종사자들의 경우에는 전통적인 근로자와 사용자 개념에 의해 포섭되기 어려운 자이며, 자영업자라고 할 수 없는 경제적 종속성을 지닌 자들이다. 그렇기 때문에 이들에 대한 사회적 보호가 가장 필요 되며, 그렇기 위해서 이들을 강제로 보호할 필요성이 가장 높게 보여진다는 것이다.
또, 이와 비슷한 방법으로는 적용제외 신청 규정을 삭제하는 방법이 있는데, 적용제외 방법은 법의 적용을 원치 않을 경우 보험 공단에서 이 법의 적용 제외를 신청할 수 있는 것을 의미한다. 그러나 이러한 적용제외신청 규정을 삭제하기 위해서는 아마도 먼저 말하였던 강제적인 보험의 가입이 선행되어야 할 필요성이 있다고 보인다.
이 외에도 정책적인 고려를 통하여 특수형태근로종사자에 부여하는 보험급여 수준을 종래의 근로자에 대한 것 보다는 낮게 하는 것이 가능하다면, 특수형태근로종사자가 갖게 되는 보험금에 대한 부담이 조금은 줄어 들 것으로 보여진다. 즉, 사업주와 종사자가 1/2씩 분담하도록 되어있는 현재의 제도에 변화를 주는 것이 필요하다는 것이다. 본래 산재보험료는 6개 직종별 각각의 월기준 보수와 특수형태근로종사자의 노무제공 일수, 해당 사업장의 개별보험료율에 의하여 산정하도록 규정되어 있다.
만약 이러한 산재보험의 보험료를 사업주부담의 원칙으로 하면서 예외적으로 각 당사자의 비용분담을 규정토록 한다면 사업주가 복수로 존재한다고 하여도, 수입의 반 이상을 의존하는 사업주가 보험료 부담을 지게 하면서, 사업주에게 노무를 제공할 경우, 소득에 비례하여서 보험료를 분담하는 방법도 가능 할 것으로 보여진다. 실제로 보험료 부담의 문제의 경우에는 상당부분이 이미 민간상해보험을 통해서 보험료를 부담하고 있는 사업주가 많이 존재하기 때문에 추가적인 비용부담은 크지 않을 것이라고 생각된다.
그러나 반대로 특수형태근로종사자의 비용부담을 생각할 때 이들 특수형태근로종사자의 경우에는 소득이 취약하기 때문에 50%라는 종사자 부담액이 현실적으로 부담으로 작용된다. 그렇기 때문에 이러한 부담을 경감시키는 방안이 생긴다면, 보험료에 대한 실질적인 고민이 줄어들기 때문에 보험을 이용하는 사람이나 실질적인 고용주나 어느 곳에서도 어려움이 없을 것이라고 보여진다.
앞서 말한 것처럼 법에서는 그 내용을 규정하기만 하였을 뿐 어떠한 방법으로 어떠한 절차를 통하여 지급을 해줄 것이라는 고시가 명확하게 되어있지 않다. 일반근로자의 경우에는 산재보험이 해당 업종의 일반산재보험료부과 징수 보상방식에 따라서 연 4회로 나뉘어 개산보험료로 부과되고 징수되고 있으며, 그에 대한 보상도 실제의 산재근로자의 평균임금에 따라서 지급이되고 있다. 그러나 특수형태근로종사자의 실재적인 소득파악은 개개의 특성상 어려우며, 소득의 편차가 크나 취업자로서 산재보험혜택을 받을 만한 사회적인 보호의 필요성이 인정된다는 차원에서 결국 해당 직군별로 정액의 산재보험료 부과와 정액보상제를 구축하는 것이 불가피한 측면이 있다.

이처럼 특수형태근로종사자는 사용자의 지휘감독을 받으면서도 근로기준법상 근로자로 인정받지 못해 사회보험의 사각지대에 놓여 왔고, 산재보험은 특례 조항을 통해 이들을 단계적으로 보호해 왔습니다. 노동법이나 사회보장법 과목에서 이 주제를 다룰 때는 적용 직종이 확대되어 온 과정, 적용제외 신청 사유를 제한한 개정, 전속성 요건을 없애고 노무제공자 개념을 도입한 최근 개정을 함께 정리하면 시기별 변화를 보여 주는 답안을 구성할 수 있습니다. 플랫폼 노동 종사자의 보호 문제로 논의를 넓혀 보는 것도 좋습니다.

Workers in special types of employment are formally independent contractors, but in practice they provide labor to a particular business and live on the payment they receive. The category ranges from long-established jobs such as insurance agents, home-study tutors and golf caddies to platform-based work such as delivery and designated driving.
Industrial accident insurance, introduced in 1964, was Korea's first social insurance scheme. It initially applied only to workplaces above a certain size and was gradually expanded until, from 2000, it covered almost every workplace that employs workers.
The special industrial accident insurance provisions for these workers took effect in 2008, and the list of covered occupations was expanded several times. Because workers could apply to be excluded, however, actual enrollment remained low and drew criticism; a 2021 amendment limited the grounds for exclusion to reasons such as illness or childcare.
Since July 2023, the labor service provider system has been in force, abolishing the exclusivity requirement that a worker be tied to a single business. People who work through several platforms can now be protected by industrial accident insurance.
Article 34 of the Constitution provides that all citizens have the right to a life worthy of human beings; it is frequently discussed, together with the principle of equality, as a basis for defining the scope of social security entitlements.
