The Five Powers of the Constitutional Court: Meaning and Requirements, from Constitutional Review of Statutes on Court Referral to Impeachment, Party Dissolution, Competence Disputes and Constitutional Complaints

A five-page report that explains each of the Constitutional Court's five powers, from constitutional review of statutes on referral by the ordinary courts to constitutional complaints, by meaning and requirements, with a comprehensive summary at the end. Because the same two subheadings, meaning and requirements, are repeated for each power, it is easy to read one power at a time, and the closing synthesis ties together the common purpose of all five, which makes it a handy summary resource.
The first chapter, on review of the constitutionality of statutes on court referral, explains its meaning under Article 107 of the Constitution as a procedure for correcting statutes that infringe constitutional values, and summarizes that the subject of review includes not only formal statutes but also ratified treaties, customary law and emergency orders, and the requirements that the statute must be a premise of the trial and that the referral must be made on a party's motion or by the court on its own authority.
It also explains that a statute held unconstitutional in principle loses its effect, that penal statutes lose their effect retroactively under the principle of nullum crimen sine lege, that measures based on an unconstitutional statute are not automatically void, and that while lower regulations are reviewed by the Supreme Court, the Constitutional Court has taken the position that it may exceptionally review orders and rules for the protection of fundamental rights.
The impeachment chapter explains it as a procedure for deciding whether to remove high-ranking officials whose status is guaranteed, which begins only when the National Assembly exercises its power to impeach, with the Constitutional Court examining the illegality of the impeached official's conduct and deciding. The following chapters on dissolution of unconstitutional political parties, competence disputes and constitutional complaints set out meaning and requirements in the same careful way.
The synthesis states that party dissolution protects constitutional democracy by dissolving parties that violate the basic democratic order, that competence disputes secure the balance of power by settling disputes over powers between state organs and local governments, and that the constitutional complaint is the key means by which citizens themselves directly seek relief for infringements of their fundamental rights.
It concludes that the five powers share the common aim of protecting constitutional values, preventing abuse of state power and guaranteeing citizens' fundamental rights in substance, and lists the textbook, lecture notes and the Constitutional Court website as references. Read from the standpoint of preparing written answers in law courses, the most practical part is where, in explaining the effect of a decision of unconstitutionality, it distinguishes the retroactive effect for penal statutes from the effect on measures based on an unconstitutional statute.
This is a frequently tested issue, so even a short but accurate summary is a big help. Students studying the Court's powers often mix up who may bring each type of case; organizing them by starting point (impeachment by the National Assembly, constitutional review of statutes by court referral, constitutional complaints by citizens directly) makes it far less confusing, and this report's split into meaning and requirements is a good framework for that.
When using it, note that the explanations of meaning and requirements overlap somewhat in the section on review of statutes, so trim the repetition, and adding one representative decision or the relevant article number for each power will make your answer much denser. The synthesis paragraph is a good summary to draw on when writing a conclusion. Compared with other materials on the same topic, this paper devotes more space to the procedural flow of each type of case (petition, hearing and the kinds of decisions), so it suits those who want to study with a focus on procedure.

권한쟁의심판은 국가기관과 지방자치단체 간의 권한 다툼이 있을 때 조정하고 결정하는 헌법재판소의 권한을 말한다. 이 심판은 국가기관 간, 또는 지방자치단체 간 헌법이나 법률에 의한 권한의 범위와 내용에 대해 다툼이 발생한 경우에 개시되고, 헌법의 규범적 효력을 보호하게 된다. 권한쟁의심판의 당사자는 국가기관 또는 지방자치단체로 한정되며, 국가기관에는 국회, 정부, 법원, 중앙선거관리위원회 등이 포함된다.
권한이 침해되거나 침해될 우려가 있는 경우, 권한쟁의심판 청구가 가능하다. 심판은 재판관 7인 이상의 출석으로 진행되며, 과반수 찬성으로 결정이 이루어진다. 결정은 각하, 기각, 인용결정으로 나뉘며, 인용결정이 내려진 경우 헌법재판소는 피청구인의 처분을 취소하거나 무효를 확인할 수 있다.
부작위에 대한 심판청구의 경우 피청구인이 처분을 하도록 명령할 수 있다. 이로써 헌법재판소는 권한쟁의를 해결하여 헌법질서를 유지하고 공적 권한의 충돌을 조정한다.
2) 요건 권한쟁의심판은 국가기관 또는 지방자치단체 간에 헌법이나 법률에 의해 부여된 권한을 둘러싸고 다툼이 발생할 때 해결하는 절차를 의미한다. 국가기관과 지방자치단체가 각자의 권한과 의무에 대해 분쟁이 발생할 경우, 헌법재판소가 조정하여 권한의 적법한 행사를 보장한다. 권한쟁의심판의 당사자는 국회, 정부, 법원, 중앙선거관리위원회, 특별시, 광역시 등 다양한 국가기관 및 지방자치단체로 한정된다.
헌법재판소는 분쟁 해결을 위해 7인 이상의 재판관이 출석해 사건을 심리하며, 권한의 침해 여부를 판단하고, 적절한 권한행사 기준을 제시한다. 권한쟁의심판은 공공기관 간의 권력 균형과 협력 체계를 유지하고, 헌법상 권한의 충돌을 조정하여 국가기능의 원활한 수행을 도모한다.
헌법소원은 공권력의 행사나 불행사로 기본권이 침해된 경우, 당사자가 헌법재판소에 심사를 청구하여 구제를 받는 절차를 말한다. 헌법소원은 권리구제형 헌법소원과 위헌심사형 헌법소원으로 나뉘며, 위헌심사형은 위헌법률심판과 절차적 차이가 있다. 권리구제형 헌법소원은 청구인이 공권력 행사나 불행사로 인해 기본권 침해를 주장하는 경우에 청구할 수 있다.
헌법소원청구인은 청구의 요건으로 청구인, 침해된 권리, 침해의 원인이 되는 공권력의 행사 및 청구 이유 등을 기재하여야 한다. 헌법재판소는 심리 과정에서 서면심리와 변론을 통해 청구의 타당성을 평가하고, 각하, 기각, 인용결정 중 하나를 내린다. 인용결정이 이루어진 경우 공권력 행사의 취소나 위헌확인결정을 내릴 수 있으며, 해당 기관을 구속하는 효력을 갖는다.
이처럼 헌법소원은 국민이 직접 청구 주체가 되어 공권력에 의한 기본권 침해를 구제받는 제도라는 점에서 헌법재판소의 다른 심판과 구별됩니다. 헌법학이나 통치구조론에서 헌법재판소의 다섯 가지 권한을 공부할 때는 법원의 제청에 의한 위헌법률심판, 국회의 소추에서 시작되는 탄핵심판, 정부의 제소로 열리는 위헌정당해산심판, 기관 간 권한쟁의심판을 절차의 출발점과 인용 정족수 기준으로 비교해 정리하면 이해가 쉬워집니다. 형벌 법규의 소급 실효와 헌법불합치 같은 변형결정도 함께 알아 두면 결정의 효력을 묻는 문제에 대비할 수 있습니다.

Constitutional adjudication is a system that protects the Constitution's status as the supreme norm by reviewing whether statutes or exercises of public power conform to it. Some countries use the American model of judicial review, in which ordinary courts also handle it, while others use the centralized German model with a separate constitutional court; Korea has used the centralized model, with a Constitutional Court, since 1988.
Article 111 of the Constitution assigns to the Constitutional Court review of the constitutionality of statutes on court referral, impeachment, dissolution of political parties, competence disputes between state organs, between state organs and local governments, and between local governments, and constitutional complaints as prescribed by law; the Constitutional Court Act sets out the procedures in detail.
Article 107(2) of the Constitution gives the Supreme Court final authority to review whether orders and rules violate the Constitution or statutes when this is a premise of a trial, while Constitutional Court precedent holds that orders or rules that directly infringe fundamental rights can be the subject of a constitutional complaint. The scope of review of the two courts is therefore a frequently discussed issue in constitutional law.
