Self-Defense Law in Korea vs. the U.S.: Requirements, Excessive Defense, Key Korean Cases and Stand Your Ground

An 8-page Korean criminal law report on self-defense. It explains the three requirements under Article 21 of Korea's Criminal Act, how courts handle excessive defense, cases where self-defense was and wasn't accepted, and why Korea's approach is far narrower than U.S. law with its castle doctrine and stand-your-ground statutes, ending with proposals for a balanced standard.
사회가 발전하고 인권이 부각되며 그에 따른 많은 법이 만들어지고 시행됨에 따라 딸려 오는 부작용도 만만치가 않다. 인간의 존엄성이란 윤리적 부분과 그 존엄성을 어떤 상황까지 용납해야 하는 가라는 법률상의 모순은 지금까지도 논란이 되고 있다.
그렇다면, ‘정당방위’의 정의와 허용 범위, 실제 정당방위 판례와 선진국의 하나인 미국과 우리나라의 정당방위 법 차이점, 그리고 앞으로의 방향에 대해 논의해보겠다.
정당방위와 과잉방위의 사이에서 한국에서의 정당방위의 정의와 허용범위, 정당방위가 허용됐던 판례와 허용되지 않았던 판례, 그리고 마지막으로 미국과 한국의 정당방위 법의 차이를 알아보았다. 미국은 개인의 정당방위 범위에 대해 매우 넓게 인정해주는 편이어서 개인의 권리를 보호할 수 있는 반면, 범죄자의 인권이 심각하게 침해될 수 있다. 한국은 범위가 좁고 상황에 따라 개인의 권리가 온전히 지켜지지 못할 경우가 있다.
우리는 대한민국에 살고 있고, 우리나라의 문화적 통념과 역사 등으로 인해 범죄자의 인권도 존중해주고 보호해주는 정당방위 법 안에 살고 있다. 각 상황에 맞게 최대한으로 조율 본 법이 지금의 법이라고 한다면, 우리는 이 안에서 위법하지 않으면서도 내 자신을 지킬 수 있는 방법을 찾아봐야겠다.
미국과 한국은 법 제도, 역사, 문화 등 여러 요인에 따른 차이가 있기 때문에 어느 한 쪽이 무조건적으로 옳다거나 좋다고 하기보다는 절충적이고 종합적인 상황을 고려해 사회적인 법 내에서 해결해야 한다고 생각한다. 물론 최선은 미리 법을 준수하고, 서로의 권리를 존중하며 침해하지 않는 것이다.
참고로 2016년 '도둑 뇌사 사건'(대법원 2016. 5. 12. 선고 2016도2794 판결)에서 대법원은 이미 제압되어 도망만 하려던 절도범을 계속 폭행해 숨지게 한 행위를 정당방위도 과잉방위도 아니라고 보았습니다. 침해가 끝난 뒤의 추가 폭행은 방위 의사보다 공격 의사가 앞선다고 본 것으로, 침해의 현재성 요건을 설명할 때 좋은 예가 됩니다. 결론을 쓸 때 함께 다뤄 보세요. 제21조 제3항의 야간 과잉방위 규정과 함께 비교하면 답안이 더 풍부해집니다.
