Essay Answers on the Constitutional Ruling Upholding Takju Supply-Area Restrictions: Least-Restrictive-Means Review, Epistemic Reasons, Treating People Merely as Means, and the Presumption of Innocence and Burden of Proof

An eight-page set of answers that works through four constitutional argumentation problems in turn, from the least-restrictive-means reasoning in the ruling that upheld supply-area restrictions on takju (Korean rice wine, makgeolli) to the presumption of innocence and the burden of proof. The first problem examines the 1999 Constitutional Court decision that upheld the takju supply-area restriction in Article 5(3) of the Liquor Tax Act, specifically the part that cited, as grounds for minimal infringement, a proviso allowing the regional tax office commissioner to change the supply area only within the same jurisdiction.
The answer separately addresses identifying the issue, the subject of the least-restrictive-means review, and whether the fact that an even more restrictive system with no possibility of change is conceivable is a proper argument; it criticizes the restriction by noting that regional limits justified by takju spoiling and deteriorating no longer fit, given advances in sealing and distribution technology, and that less restrictive means exist, such as labeling expiry dates or inspecting storage practices.
The second problem concerns a hypothetical law punishing anyone who questions the state's official disease-control information. After distinguishing epistemic reasons, which bear on whether something is true or false, from non-epistemic reasons, which compel behavior by attaching disadvantages, it concludes that mixing the two leads to violations of fundamental rights and weakens the logical basis of legislation. The third problem discusses whether using a hairdresser's labor and going to a different salon if you are not satisfied amounts to treating a person merely as a means, in light of two requirements: being used only as a tool, and the absence of a right to refuse.
The last problem, in a case where A and B have each filed assault complaints against the other, examines the problem with using the words 'victim' and 'perpetrator' before judgment, and the constitutional principles on distinguishing positive from negative facts and on the burden of proof, in an introduction-body-conclusion format, explaining the dual character of the presumption of innocence in Article 27(4) of the Constitution as both a rule and a principle.
It is a good reference for essay assignments and end-of-term written exams in constitutional law, philosophy of law and legal argumentation classes. In particular, the way the first problem first separates identifying the issue from the subject of the least-restrictive-means review is good practice for picking out the key question when reading Constitutional Court decisions, and the second and third problems are examples of compressed writing that links definitions directly to conclusions in a short space.
Each problem is followed by references, mostly doctoral dissertations, which makes it easy to find material for further reading. When I read legal answers, I tend to look at the connections between sentences before the conclusion, and I struggled quite a bit with this topic when I first studied it. Least restrictive means easily brings to mind only the question of whether a less restrictive alternative exists, but this problem asks why the fact that a more restrictive system is conceivable cannot be a ground for constitutionality.
Here is how I worked it out. If you have ever looked for your hometown makgeolli in a supermarket while traveling and come back empty-handed, you will naturally think that clearly labeling expiry dates and checking refrigeration would be less inconvenient for both consumers and breweries than locking down where it can be sold. I was glad the answer pinpoints exactly this: the comparison should be with a better alternative, not a worse system.
Following the material and looking up the related doctoral dissertations, I felt that all four problems are tied together by one idea: if the state wants to compel something, it has to give reasons. Students often get stuck on the last problem, because unless you notice that the phrase 'the victim's consistent testimony' already contains the conclusion, the judge's reasoning looks plausible. When using this for your own assignment, borrow the answers' framework of three steps for each problem (explaining the concept, applying it to the facts and critiquing), and be sure to rewrite the last problem in your own sentences, since some paragraphs appear close to the wording of the references.
Reading it with the original decision open beside it doubles the benefit.
헌법 제27조 제4항은 형사재판절차에서 피고인에게 ‘무죄추정의 권리’를 보장한 것이다. 무죄추정의 권리는 재판청구권의 일종으로서 ‘효과적인 권리보호를 제공하는 재판’을 위하여 필요한 권리이다. 무죄추정의 권리는, 첫째 형사소송에서 입증책임이 검사에게 있다는 것, 둘째 검사는 피고인이 유죄라는 점을 합리적 의심의 여지 없이(beyond reasonable doubt) 입증하여야 한다는 것, 셋째 의심스러운 때는 피고인의 이익으로(in dubio pro reo), 즉 무죄가 선언되어야 한다는 것, 넷째 유죄가 확정될 때까지 해당 재판에서 피고인에게 유죄를 전제로 하는 형벌 또는 형벌에 준하는 불이익처분을 내릴 수 없다는 것을 내용으로 한다.
이러한 내용에 반하는 입법은 무죄추정의 권리를 침해하는 것이다. 무죄추정의 성격상 권리는 무죄추정이 깨지는 순간 침해되는 것이며, 제한의 정도를 따지는 과잉금지원칙이 적용되지 않는다. 무죄추정은 형사재판에서의 권리 이상의 권리, 더 나아가 헌법 전반을 관통하는 원리로서의 성격도 갖는다.
헌법 제27조 제4항과 법치국가원리에서부터 국가형벌권 행사에 대한 절차적 통제원리로 무죄추정원칙이 도출된다. 무죄추정원칙은 형사절차 전반에 적용되는 기본이념이자 지도원리이기 때문에 형사재판 전에도 적용된다. 따라서 형사피고인뿐만 아니라 피의자도 형사절차에서 무죄로 추정된다.
즉 재판단계뿐만 아니라 일반 국민이 범죄를 저지른 것으로 의심받을 때도 국가와 시민 사이에 적용되어야 할 적절한 관계를 반영하는 법적 보호장치이다. 무죄추정 원리는 재판을 담당하는 법관뿐만 아니라 검사 경찰 등 법집행공무원에게 피고인뿐 아니라 피의자가 범죄자가 아닐 수 있다는 전제에서 판단하고 행동하도록 하는 행위규범으로 작용한다. 이에 따라 경찰과 검찰은 비록 유죄의 의심을 가지고 수사를 하더라도 유죄의 증거뿐 아니라 무죄의 증거도 살펴봐야 할 의무를 진다.
또 유죄가 확정될 때까지 피의자에게 유죄를 전제로 하는 형벌 또는 형벌에 준하는 불이익처분을 내릴 수 없다. 무죄추정원칙은 이처럼 유죄의 심증으로 피의자를 대할 때 나타날 수 있는 인권침해적인 행동을 예방하는 역할을 한다.

무죄추정은 형사재판에서는 피고인의 기본권이며, 형사재판 이전단계에서는 헌법원칙이다. 헌법 제27조 제4항의 무죄추정은 권리로서 그 내용이 확정적이다. 형사재판에서 피고인을 무죄로 추정하느냐, 추정하지 않으냐의 문제만 있을 뿐이다.

의 무죄추정의 권리를 침해하는 것이다. 이에 반하여 원리 또는 원칙으로서 무죄추정은 불확정적이다. 무죄추정원칙은 형사재판뿐만 아니라 재판 전 수사단계 등 형사재판절차 전반에 걸쳐 피의자⋅피고인을 무죄로 취급하도록 요구하여 국가형벌권의 행사를 통제하는 원리이다.
무죄추정원칙의 규범 내용이 확정되기 위해서는 형량이 필요하다. 무죄추정원칙은 피의자⋅피고인을 일응 무죄로 취급하라 또는 대우하라는 행위규범이나, 관철의 정도는 구체적인 법적⋅사실적 조건 아래서 형량을 통해서 확정된다. 헌법재판소가 최근 무죄추정원칙을 독자적인 위헌심사기준으로 활용하고 있는 것은 바람직한 방향이다.
이처럼 무죄추정은 형사재판에서는 확정적인 권리로, 재판 이전 단계에서는 형량이 필요한 원칙으로 작동합니다. 헌법과 법철학, 법학적 논증 수업에서 탁주 공급구역제한 합헌결정의 피해최소성 심사, 인식적 이유와 비인식적 이유의 구별, 칸트의 한낱 수단 취급 금지, 적극적 사실과 소극적 사실에 따른 입증책임 배분을 함께 정리해 두면, 국가의 기본권 제한과 법관의 판단이 모두 근거 제시를 통해서만 정당화된다는 헌법적 논증의 공통 원리를 서술형 답안에서 일관되게 보여 줄 수 있습니다. 개념 설명 뒤에 사안 포섭과 비판을 차례로 배치하는 구성도 함께 익혀 두면 좋습니다.

The principle of proportionality (prohibition of excessive restriction) is the limit the state must observe when restricting fundamental rights, derived from Article 37(2) of the Constitution. The Constitutional Court reviews it using four criteria: legitimacy of purpose, appropriateness of means, minimal infringement and balance of interests. Of these, minimal infringement asks whether there is a means that achieves the legislative purpose to the same degree while restricting fundamental rights less.
Kant said to treat humanity never merely as a means but always at the same time as an end. Using other people's labor or help is not prohibited in itself; the problem arises when a person is treated only as a tool, ignoring their consent and autonomy.
Article 27(4) of the Constitution provides that a criminal defendant is presumed innocent until a judgment of guilt becomes final. Accordingly, in criminal trials the burden of proving guilt lies with the prosecutor, guilt must be proven beyond reasonable doubt, and doubt is resolved in the defendant's favor.
In legal argumentation, instead of fixing a conclusion first and choosing words to fit it, it is important to check whether the words used before the judgment already contain the conclusion. Using the terms 'victim' and 'perpetrator' before a judgment presupposes facts that have not yet been proven.
