Special support for elderly victims of domestic violence is provided through links with elderly welfare services and elder protection agencies. Elder protection agencies provide comprehensive services such as temporary protection in dedicated shelters for victims, medical services, professional counseling and housing support, offer professional counseling to abusive family members, and connect them with welfare services. In addition, through links with elderly welfare services, elderly victims who meet the eligibility requirements for benefits such as basic livelihood security or the basic old-age pension but do not receive them are helped to enter free elderly care homes or group homes for the elderly. In particular, where a victim's poor living conditions have led to sexual violence, improvement and support are actively considered.
This paper has examined the Ministry of Justice's support system for victims of elder abuse. The legal basis for dealing with elder abuse currently depends on the Welfare of the Elderly Act. A 2004 amendment to that act created a legal basis for preventing elder abuse and supporting its victims, but shortcomings such as the lack of grounds for separating abusers have been pointed out. Besides the Welfare of the Elderly Act, laws related to elder abuse include the Act on Special Cases Concerning the Punishment of Domestic Violence Crimes and the Act on the Prevention of Domestic Violence and Protection of Victims, but these focus on preventing violence by family members and protecting victims.
To add: the 2004 amendment to the Welfare of the Elderly Act created a definition of elder abuse and a legal basis for elder protection agencies, and abuse can be reported to the elder abuse hotline 1577-1389 or to 112. Medical personnel, social welfare facility workers and others must report elder abuse they learn of in the course of their work (Article 39-6 of the Welfare of the Elderly Act). The 'basic old-age pension' in the paper was replaced by the basic pension in July 2014. The specifics of crime victim support, especially the scope of court-appointed lawyers for victims and personal protection, vary by type of crime and statute and should be checked.
