A common stumbling block in structure-of-government exams is failing to distinguish constitutional review of statutes from constitutional complaints, especially complaints against statutes; this paper clearly states the premise-of-trial and court-referral requirements of statutory review, giving you a starting point for that comparison.

When using it, I suggest adding one real decision each for impeachment and party dissolution, and making a table of how the quorum for upholding differs by power. Memorizing article numbers and quorums together prepares you for both multiple-choice and written questions. Reading it with an eye to the fact that each of the five powers starts from a different state organ or from citizens also makes it natural to understand why the Constitutional Court is called the counterweight of the separation of powers.

Because a statutory basis is given with almost every sentence, it is also convenient to study it alongside a textbook.

헌법소원은 공권력의 행사 또는 불행사로 인해 헌법상 보장되는 기본권을 침해받는 경우 당사자가 공권력의 위헌심사를 청구하여 기본권을 구제받는 것을 말한다. 이를 통해 헌법질서를 보호하고 당사자의 기본권을 구제받을 수 있다. 헌법소원심판은 권리구제형 헌법소원심판과 위헌심사형 헌법소원심판으로 구분된다.

다만 위헌심사형 헌법소원심판은 위헌법률심판과 동일하나, 법원의 제청신청 기각과 신청 당사자의 헌법소원심판청구라는 요건에서 차이가 있고 이에 대한 절차적 요건과 부수적 효력에서만 차이를 보인다. 반면 권리구제형 헌법소원심판은 당사자가 청구인 능력을 갖추어야 하고, 공권력 행사 또는 불행사로 헌법상 보장된 기본권 침해에 대한 주장이 있어야 하고, 다른 법률에 구제절차가 있는 경우 그 절차를 모두 마쳐야 한다. 이외에도 권리보호의 이익과 절차적 요건을 갖추어야 한다.

여기서 청구인 능력은 기본권주체성을 가지는 대상인 자연인과 단체, 공법인을 의미하고, 공권력이란 국가기관 뿐 아니라 공법인, 영조물 등에 이루어지는 고권적 작용을 의미한다. 행정행위 역시 공권력에 해당하지만 행정행위에 의한 기본권 침해는 행정쟁송을 통해 구제가 이루어지기 때문에 행정소송의 대상이 되지 아니하는 행정행위만 헌법소원심판의 대상이 된다. 권리구제형 헌법소원심판에서는 침해의 자기관련성과 직접성, 현재성 등을 평가하게 된다.

헌법소원심판의 청구인은 심판청구서에 청구인 및 대리인, 침해된 권리, 침해의 원인이 되는 공권력의 행사 또는 불행사, 청구이유 등 필요한 사항을 기재하여야 한다. 헌법소원심판은 서면심리에 따라 이루어지고, 재판부는 필요한 경우 변론을 통해 당사자나 이해관계인, 기타 참고인의 진술을 들을 수 있다. 헌법재판소는 헌법소원심판에 대하여 심판절차종료선언결정, 각하결정, 기각결정, 인용결정을 할 수 있다.

심판절차종료선언결정은 청구인이 사망하였거나 수계할 당사자가 없는 경우 또는 청구를 취하한 경우 이루어진다. 각하결정은 헌법소원심판청구가 부적법한 경우 이루어지며, 보정이 가능한 경우 흠결을 보정하고 다시 심판청구를 할 수 있다.

청구의 이유가 없는 경우 기각결정이 이루어지고, 재판관 6인 이상의 찬성이 있는 경우 인용결정이 이루어진다. 인용결정이 이루어지면 공권력의 행사를 취소하거나, 공권력의 불행사 또는 침해가 종료된 공권력의 행사에 대한 위헌확인결정이 이루어질 수 있고, 이는 국가기관과 지방자치단체를 기속하게 된다.

Basics of constitutional adjudication for understanding the Court's powers

Korea's Constitutional Court was established in September 1988 under the Constitution as revised for the ninth time in 1987. It consists of nine justices, three each designated or elected by the President, the National Assembly and the Chief Justice of the Supreme Court; justices serve six-year terms and may be reappointed. The President of the Constitutional Court is appointed by the President of the Republic from among the justices with the consent of the National Assembly.

Decisions of the Constitutional Court are made after deliberation attended by at least seven justices. Ordinary decisions require a majority of the justices present, but a decision that a statute is unconstitutional, an impeachment decision, a decision to dissolve a party, a decision upholding a constitutional complaint, or overruling a previous precedent requires the votes of at least six justices.

Constitutional complaints are divided into rights-remedy complaints, filed by a person whose fundamental rights have been infringed by the exercise or non-exercise of public power, and review-type complaints, filed directly by a party when a court has denied their motion to refer a statute for constitutional review. Rights-remedy complaints are subject to the principle of subsidiarity: if another law provides a remedy, all of those procedures must be exhausted before filing.

Premise of the trial (relevance to adjudication): the case where a specific case is pending before a court and its outcome depends on whether the statute in question is constitutional.
Binding force: the effect by which Constitutional Court decisions bind the courts, state organs and local governments.
Decision of nonconformity with the Constitution: a modified decision that keeps an unconstitutional statute in effect for a set period when immediate invalidation would cause confusion.
Impeachment motion: the procedure by which the National Assembly asks the Constitutional Court to remove a high-ranking official for illegal conduct in office.
Principle of subsidiarity: the principle that a constitutional complaint may be filed only after all other legal remedies have been exhausted.
