첫째, 2개 이상의 문헌을 상호 조합시켜서 진보성을 판단하는 경우에는 그 구성요소가 이미 공지일지라도 그 조합의 기술적 곤란성의 유무를 검토하여야 한다.

둘째, 청구항에 기재된 발명과 상이한 기술분야의 인용발명을 선행기술로 사용할 경우에는 양 기술 분야의 관련성, 과제 해결의 공통성 및 기능의 동일성 등 객관적 타당성을 충분히 검토한다.

셋째, 주지·관용기술이 거절의 주요 근거가 되는 경우 가능한 한 관련문헌을 제시할 필요가 있으며, 미완성 발명 쪼는 자료의 부족으로 표현이 불충분한 것이라 하더라도 그 기술분야에서 통상의 지식을 가진 자가 경험칙에 의하여 용이하게 기술내용의 파악이 가능하다면 그 대상이 될 수 있다.

넷째, 청구항에 기재된 발명은 전체의 결합으로 판단하여야 한다. 그러나 발명의 구조, 방법, 기능 등 요소가 유기적으로 결합되어 ㅇ씨지 아니하고 단순한 조합에 불과할 경우에는 각 부분별로 비교하여 어느 부분에도 진보성이 없으면 청구항에 기재된 발명의 진보성은 부정된다.

다섯 번째, 명세서에 발명의 유리한 효과가 명시적으로 기재되어 있지 않을 경우에는 원칙적으로 고려될 수 없다.

대다수의 발명들이 속하는 수집발명은 복수의 공지된 기술의 수집에 의하여 구성되어 있는 발명으로, 수집발명 중 진보성이 부정되는 것을 「단순한 조합」또는 주합이라고 한고 진보성이 인정되는 것을 결함 또는 조합이라 한다.

치환발명이란 동일한 기술분야에서 공지발명의 특정한 구성요소를 다른 공지발명의 구성요소로 대체하여 구성된 발명을 의미한다. 또한 다른 기술분야에서 공지발명을 당해 기술분야로 대체하는 것을 전용발명이라 한다.

그 발명품의 판매가 시장에서 종래의 동종제품을 누르고 상업적 성공을 거두고 있는 경우, 또는 이에 준하는 경우, 예컨대 종래품보다 우수하다는 평가를 사용자들로부터 받는다든가, 현저한 매상고를 올리고 있다든가 하는 사실은 그 발명에 지보성이 있음을 입증하는 참고적 자료가 될 수 있다.

발명이 출원되어 공개되기 직전까지 지속되던 것이어야 한다.

모방품이 시장에 존재한다는 것, 특히 출원발명의 진보성을 다투는 경쟁업자가 발명품을 모방품 그대로 생산하고 있다는 것은 그 발명이 진보성이 있다는 것을 추정케 한다.

나중에 후출원한 어떤 출원인이 앞의 명세서, 도면이 공개되어진 어떤 부분을 자기의 특허청구범위에 기재하여 출원하게 되면 앞의 출원과 동일한 발명으로 보아 거절된다. 이를 ‘확대된 선출원의 지위’라 한다.

출원 후 1년 6개월이 지나면 모든 출원은 공개하고, 또한 특허법 제29조 제3항의 규정을 신설하여 후출원배척의 범위를 특허청구범위에서 명세서와 도면에까지 확대시켰다.

확대된 선출원의 지위를 인정하여 특허청구범위 이외의 부분이라도 출원공개 또는 등록공개가 되었다면 명세서나 도면에 기재된 선출원의 지위를 인정하여 이후에 후출원이 비록 특허요건을 구비하고 있다 해도 거절시킬 수 있도록 하고 있다.

청구항별로 당해 특허출원의 특허청구범위에 기재된 발명과 타 출원의 최초명세서·도면에 기재된 발명을 대비하여 판단한다.

①당해 특허출원을 한 날 전에 타 출원이 있어야 한다.

②당해 특허출원을 한 후 타 출원의 공개가 있어야 한다.

확대된 선출원의 지위 판단은 선출원주의 판단과 마찬가지로 특허독립의 원칙상 국내만을 고려하여 판단한다.

특허번 제29조 제3항·제4항의 적용에 대한 판단은 당해 출원의 「청구항에 기재된 발명」과 타출원의 최초 출원시 출원서에 첨부된 명세서 또는 도면에 기재된 발명 또는 고인이 동일한가에 대한 판단이다.(2)동일성 판단방법

확대된 선출원의 지위를 위반하게 되면 등록 전에는 거절이유, 정보제공사유에 해당되며, 등록 후에는 특허무효사유에 해당된다.

동일한 발명에 대하여 발명의 선후관계를 기준으로 하여 먼저 발명한 자에게 특허를 허여하는 것을 「선발명주의」 또는 「최선발명자 특허주의」라고 하며, 발명의 선후 여부에 관계없이 출원의 선후관계를 기준으로 하여 선출원자에게 특허를 허여하는 것을 「선출원주의」 또는 「최선출원자 특허주의」라고 한다.

선출원주의는 대부분의 국가가 채택하고 있는 제도이며, 발명의 완성 선후에 관계없이 먼저 출원 한 자에게 특허를 허여하는 제도로서, 자신의 발명을 누구보다도 먼저 사회에 공개하여 사회이익에 기여한 자에게 반대급부로서 독점권인 특허권을 부여한다는 취지에 입각한 제도이다.

Background for understanding the patentability requirements

Article 29 of Korea's Patent Act sets out the patentability requirements. Paragraph 1 requires novelty: an industrially applicable invention must not have been publicly known or publicly worked, or described in a publication, before filing. Paragraph 2 sets out inventive step: a person of ordinary skill in the field must not have been able to make the invention easily.

In Korean practice, methods of diagnosing, treating or preventing human disease are treated as lacking industrial applicability and are not patented. Inventions of products such as medical devices and pharmaceuticals, however, can be patented.

Even if you disclose your own invention before filing, you can file within a set period and claim the grace-period exception, so that the disclosure is not treated as prior art when novelty and inventive step are assessed. The current period is 12 months from the date of disclosure.

The enlarged scope of prior applications, found in Article 29(3) and (4), bars a patent for a later-filed invention identical to one described in the specification of another application that was filed earlier but published later. When several applications claim the same invention, the first-to-file principle in Article 36 gives the patent to whoever filed first.

Case law and examination guidelines repeatedly stress that inventive step must be assessed without hindsight, because once you know the invention it can seem as if anyone could easily have thought of it.

Novelty: the requirement that the same invention must not have been known before filing.
Inventive step: the requirement that a person of ordinary skill could not easily have made the invention.
Grace-period claim: a request to exclude the applicant's own pre-filing disclosure from the prior art.
