Korean Patent Law and Other Legal Measures: Effects and Limits of Patent Rights, Prior User, Intermediate User and Later User Rights, and Abuse of Market Dominance

A ten-page intellectual property law report on what effect a patent right has, how far it is limited, and what measures can be taken inside and outside the Patent Act. The whole paper is driven by one question: how to balance the interests of patent holders and third parties. It consists of an introduction, body, conclusion and references. The introduction starts from the point that patents matter more as trade grows, and presents the dilemma that recognizing patents too broadly hinders industrial development while recognizing them too narrowly discourages invention.
The body has four chapters: an overview of patent rights, limits on patent rights, the concepts of prior user, intermediate user and later user rights, and legal regulation. The references list three master's theses on patent infringement, limits on patent effect and international protection. The overview explains that a patent is a property right yet arises from an administrative act, registration by the Korean Intellectual Property Office, and covers its term, extinction and the retroactive effect of an invalidation decision; based on Article 94 of the Patent Act (exclusive right to work the patented invention as a business) and Article 97 (scope of protection defined by the claims), it distinguishes the positive and negative effects of a patent.
The section on limits covers, in turn, the temporal limit (the effect ends when the term expires), the territorial limit under the principle of territoriality, and substantive limits arising from the constitutional duty to exercise property rights in conformity with public welfare and from the prohibition of abuse of rights. It then explains the prior user right, granted to those who in good faith worked or prepared to work the invention before the patent application; the intermediate user right, for cases where the original holder of a patent later invalidated, among others, worked it in good faith; and the later user right, granted to third parties who worked the invention in good faith before the patent was restored on retrial.
Finally, the regulation section uses the Samsung Electronics v. Apple patent dispute as an example to summarize corrective orders and surcharges under the Fair Trade Act for abuse of a market-dominant position, criminal penalties and civil damages, and names the injunction claim as the remedy most used in practice. It is a good reference for essay-type assignments in intellectual property law, patent law and economic law classes.
When people have an idea for an invention, many assume that getting a patent protects everything. Look a little closer at patent law, though, and it quickly becomes clear that a patent is an exclusive right but not an unlimited one. As I see it, this report walks through exactly those limits, divided into time, place and substance. Reading the prior user right section reminded me of a local restaurant story. If one shop registered its secret sauce recipe, it would be unfair to tell a neighboring shop that had already been making and selling a similar sauce to close overnight.
This material explains well that this sense of fairness is why the Patent Act separately provides prior user, intermediate user and later user rights. Many students confuse the three concepts, but comparing them by when the good-faith use took place makes them easy to tell apart: before the application, it is a prior user right; after invalidation, an intermediate user right; before restoration on retrial, a later user right.
However, the parts that treat the Samsung Electronics v. Apple dispute as a typical case of abuse of market dominance, or that state that detention is the rule after a criminal complaint, may differ from actual case law and procedure. When you use them in an assignment, it is safer to check the Korea Fair Trade Commission's decisions or court judgments directly and refine the wording. To make the most of it, organize the three limits on patent rights and the three statutory licenses in a table by requirements and effects.
If you then apply that table to one hypothetical dispute, you can answer questions about measures under the Patent Act and under other laws far more systematically.
그렇다면, 특허법 이외의 법률상으로는 어떠한 조치가 가능할 것인가? 민사상의 경우 시간이 오래 걸리고, 재심청구 등 여러 가지 다양하고 복잡한 단계를 거치게 됨으로써, 사실상 특허분쟁의 문제를 처리함에 있어서 강력한 수단으로 자리잡을 수 없다. 이러한 형사상 특허분쟁의 경우, 피고가 원고에게 고소당할 경우 법적구속을 원칙으로 삼고 조사를 시행함으로써, 사실상 가장 강력한 구제수단으로써 활용될 수 있다.
우리나라의 특허실무에서 가장 많이 사용되는 구제수단은 바로 침해금지청구권일 것이다. 우리나라의 특허법상, 금지청구권은 물권과 같은 배타적인 권리의 속성상 인정되는 구제의 수단으로 작용하므로, 특허권의 침해가 발생하면 특허권자에게 침해금지청구권을 인정하는 입법방식으로써 법원은 이와 같은 청구가 있게 되면 청구를 거절할만한 법적인 권리가 권리남용 이외에는 없게 되어, 침해금지청구를 인용할 수밖에 없게 된다. 그렇기 때문에 우리나라 특허실무에서 사실상 가장 많이 활용되는 방법이다.
또한 이러한 구제 수단은 손해배상청구권과 마찬가지로, 특허권자가 침해자의 고의 및 과실을 본인이 입증할 필요가 없기 때문에 특허권자의 입증책임을 다수 완화함으로써 유리한 위치를 점하도록 한다. 한편 침해금지 청구권과 관련된 개념은, 침해금지청구를 수행함과 동시에 침해행위를 조성한 물건의 폐기와 침해행위에 제공된 설비의 제거 및 기타 침해 예방에 필요한 행위를 청구할 수 있으므로, 가장 강력한 구제수단으로 작용한다.
특허권은 특허청에 존재하는 특허등록원부에 기재됨과 동시에 해당 효력이 발생하게 된다. 이러한 특허권은 내용상의 측면에서 바라볼 때 양면성의 특성을 보인다. 특허권의 권리범위와 보호범위에 관련하여 현행 특허법 제94조는 ‘특허권자는 업으로서 그 특허발명을 실시할 권리를 독점한다’고 규정한 바 있으며, 동일 법률의 제97조에서는 ‘특허발명의 보호범위는 특허청구범위에 기재된 사항에 의하여 정해진다’고 규정하고 있다.
배타적 금지권 및 독점적 실시권의 관계에 있어서도, 전자가 후자보다 넓다고 보는 것이 더 일반적이다. 해당 근거로 독점적 실시권은 당해 특허발명 자체의 적극적인 이용권임에 반해 배타적 금지권은 당해 특허발명 및 실질적으로 동일한 것으로 평가되는 균등한 범위까지를 침해행위로 간주하고, 이를 금지할 수 있다는 점에 기초를 두고 있다. 더 나아가 특허권자는 간접침해의 영역에까지 금지권을 행사할 수 있으며, 선원특허권자는 후원의 이용발명권에 관해서도 금지권을 행사할 수 있게 된다.
이처럼 특허권을 독점적 실시권 및 배타적 금지권을 모두 포괄하는 개념으로 바라볼 때, 특허권의 효력이 미치는 범위가 지정됨에 있어서 특허권의 권리 내지 보호범위에 관한 관념은 해당 내용에 있어서 큰 차이가 없다고 볼 수 있겠다. 단지 표현의 뉘앙스에 불과하다는 것이 일반적인 관점이다. 권리범위는 특허발명의 적극적 실시이용이라는 측면이 중시되지만, 보호범위는 특허발명의 제3자에 의한 침해 및 이와 관련된 소극적 측면이 더욱 중시된다는 점에서, 양자를 판별할 피룡가 있을 것으로 보이나, 이는 특허권 효력의 양면성을 각기 대변한 것에 불과하다고 볼 수 있겠다.
특허권은 기본적으로 독점적이고 배타적인 권리에 속하기 때문에, 특허권의 권리남용과 과대하게 넓은 권리의 인정은 오히려 산업발전의 측면을 저해할 우려가 있으며, 특허법 목적에 반하는 결과를 초래할 수 있다. 반면 특허권자의 독점적 권리행사에 대한 지나친 규제와 좁은 권리의 인정 역시, 발명자의 의욕을 상실시킴으로써 기술발전 촉진을 저해할 우려가 크다. 그렇기 때문에, 특허권을 중심으로 대립되는 특허권자와 제3자 사이의 이익을 적절하게 조절하고, 더 나아가 궁극적으로 특허법이 보이는 소기의 목적을 달성할 필요가 있다.

A patent protects an invention, defined as a highly advanced creation of technical ideas using the laws of nature. To obtain a patent, the invention must have industrial applicability, novelty and inventive step; the right arises on registration and, in principle, lasts until 20 years from the filing date.
The scope of a patent's protection is defined by what is stated in the claims. Working every element of a claim is direct infringement, and in practice it is important that even changing only part of an element while keeping the core configuration can be found to infringe under the doctrine of equivalents.
A statutory license is a non-exclusive license that arises by operation of law without the patent holder's permission. Besides prior user, intermediate user and later user rights, it includes the employer's non-exclusive license to an employee invention. These systems protect the investment and facilities of people who have run a business in good faith, in the interest of fairness.
Against patent infringement, the holder can seek civil remedies such as an injunction, damages and restoration of reputation, and willful infringement is subject to criminal punishment. In addition, if exercising a patent goes beyond its legitimate scope and restricts competition, it may be subject to regulation under the Monopoly Regulation and Fair Trade Act.
