The Act on Guarantee of Right to Health and Access to Medical Services for Persons with Disabilities was enacted on December 29, 2015 as Act No. 13661. Under Article 1 of its Addenda, it took effect two years after promulgation, on December 30, 2017. Before discussing how the Act can be linked to disability welfare centers, let us look at the purpose and basic principles of the Act through Chapter 1, its general provisions.
Article 1 in Chapter 1 states the purpose: 'The purpose of this Act is to contribute to the health promotion of persons with disabilities by prescribing matters concerning support for guaranteeing their right to health, establishing a health management system for them, and guaranteeing access to medical services.' Article 2 sets out three basic principles. First, persons with disabilities have the right to receive optimal health care and protection; second, they shall not be discriminated against in health care and medical services on the ground of disability; and third, they have the right to equal access to health care and medical services with persons without disabilities.
Note: The Act on Guarantee of Right to Health and Access to Medical Services for Persons with Disabilities was enacted on December 29, 2015 as Act No. 13661 and has been in force since December 30, 2017. It has been amended several times since, so check the current law for the details of programs and article numbers. The welfare center usage and preference rates cited in the paper are survey results from the time it was written. The general law banning discrimination on the basis of disability itself is the Act on the Prohibition of Discrimination against Persons with Disabilities and Remedies.
