Inherent Limits in Applying Social Welfare Law, Cases from the Welfare Blind Spot, and Directions for Improvement Centered on Medical Security

A report that seeks to understand social welfare law, the foundation that gives concrete form to the legitimacy of social welfare, and examines the inherent limits in applying the law, the welfare blind spots they create, and directions for improvement. It introduces the history of Korean social welfare law, which grew out of pre-modern relief programs, and explains the limits that arise because law by nature relies on precise definitions and criteria, as well as the complexity of service-use relationships caused by three-sided legal relationships.
Through the cases of Ms. A, who cannot receive medical benefits because she is separated from her husband and cannot pay health insurance premiums, and Mr. B, a 73-year-old who lives by collecting waste paper and has difficulty getting medical care despite a chronic illness, it analyzes the problem that fixed criteria fail to reflect people's actual lives, and proposes directions for improvement.
앞서 살펴본 사회복지법 한계에 따라 발생한 복지사각지대의 예를 살펴보기로 한다. 첫 번째 사례는 남편과 별거 중으로 의료보험비를 제대로 납부하지 못해 의료혜택을 받을 수 없는 A씨의 경우다. 신혼부터 A씨의 남편은 잦은 외도를 일삼으며 가족들을 등한시하였다.
아이를 낳으면 더 나아지겠거니 생각했던 A씨지만 자녀의 출산과 상관없이 남편의 외도는 더욱 심해졌다. 그러던 어느 날 A씨의 남편은 더 이상 날 차지 말라는 쪽지와 함께 홀연히 사라져 행방이 묘연했다. 이후 극심한 생활고에 시달린 A씨는 자녀와 함께 쪽방을 전전하며 어려운 생계를 이어나간다.
이런 와중 A씨를 더 답답하게 하는 것은 자녀들이 아플 때이다. 남편과 별거 중이기는 하지만 호적상 부부로 등재되어 있는 A씨는 남편이 의료보험비를 제대로 납부하지 않았는지 번번히 의료보험 혜택을 받을 수 없었기 때문이다.
어려운 형편에 이제까지 밀린 의료보험비를 낼 여력도 없는 A씨는 아이들이 아플 때마다 병원을 가지 못하고 근처 약국에서 약을 사 먹이며 전전긍긍한다. 그러던 중 최근 A씨의 첫째 아이가 통원치료가 필요한 병에 걸렸으나 이를 해결하지 못하고 있는 상황이다.
다음의 경우를 살펴보기로 한다. 올해로 73세가 된 노인 B씨는 하루종일 폐지를 주어 판 돈으로 근근이 생활을 해 나가고 있다. 허름한 단칸방에서 무더운 여름과 혹한의 겨울을 나기 힘들지만 B씨는 돈을 아끼기 위해 선풍기 한 대와 전기장판에 의지한 채 하루하루를 보내고 있다.
그러던 중 B씨의 지병이 도지며 의료 서비스 혜택이 필요하게 된다. 하지만 의료비를 감당할 수 없던 B씨는 치료를 거부하며 소염진통제로 버티고 있다. B씨의 사정을 알게 된 지역복지사들은 B씨를 돕기 위해 여러 의료 서비스 및 프로그램을 알아봤다.
하지만 결과적으로 B씨가 제공받을 수 있는 서비스는 없었다. 왜냐하면 B씨에게 한 명의 아들이 있기 때문이다. 현행법 상 일정한 소득을 가진 자녀가 있는 경우 기초생활대상자를 대상으로 한 의료 서비스를 받기 어렵기 때문이다.
그러나 B씨의 아들은 아침부터 저녁까지 고된 노동을 하며 세 아이를 키우는 아버지로 그런 아들의 사정을 잘 아는 B씨는 아들에게 생활비는커녕 병원비를 지원받을 수 없다는 입장이다. 결국 B씨가 국가적인 지원과 서비스를 받기 위해서는 B씨와의 부자 관계를 정리해야 하는 것뿐이었다.
