A short 3-page Korean constitutional law paper. It explains the founding principles of Korea's Constitution, popular sovereignty, liberal democracy, the rule of law, the welfare state and international peace, and then the basic institutions that put them into practice: political parties, elections and local self-government. Useful as a quick review sheet for intro constitutional law.
헌법은 정당제도, 선거제도, 지방자치제도 등을 규정하고 있다. ‘정당’은 정권획득을 목적으로 하는 단체로 국민과 국가 간의 정치적 의사를 매개하는 기관으로 설명된다. 국민은 정치적 결사에 의한 자유가 인정되기 때문에 참정권이 성립되는 현대 사회에서 정당의 자유로운 설립은 민주정치의 가장 필수적인 요건이 될 수 있다. 제8조에는 정당 설립의 자유와 복수정당제가 규정되어 있으며 위헌정당해산제도를 통해 정당의 목적이나 활동이 기본질서에 위배될 경우 정부의 제소에 따라 헌법재판소의 해산결정으로 정당이 해산될 수 있는 절차를 규정하고 있다.
‘선거’는 대의제를 통한 민주주의를 구현하기 위해 반드시 필요한 절차이다. 국민이 주권을 행사하는 가장 기본적인 방법이고, 대표자를 선출함과 동시에 국가의 공권력 행사의 정당성을 부여하기 때문에 통제의 기능을 수행하기도 한다. 선거제도는 보통선거, 평등선거, 직접선거, 비밀선거의 원칙으로 운영되며, 선거구를 설정하여 당선자를 선출하는 방식을 사용하고 있다. 우리나라는 다수대표제, 전국 선거구제를 기본으로 비례대표제를 병용하여 실시한다.
‘지방자치’는 일정한 지역을 설정하고, 그 지역 내의 주민이나 단체가 자신들의 책임 하에 지역의 사무를 처리하는 제도를 말한다. 민주시민을 양성하고 풀뿌리 민주주의를 실현하기 위한 것으로, 자치조직권, 자치행정권, 자치재정권, 자치입법권을 부여하여 지방분권을 실현하고 있다. 뿐만 아니라 주민의 직접 참여를 보장하기 위해 주민투표법 등을 제정하여 민주성과 책임성을 보장하고 있다.
본문에서는 대한민국 헌법이 규정하고 있는 기본원리와 기본제도에 대해 알아보았다.
참고로 기본원리마다 근거 조문을 함께 적으면 답안이 탄탄해집니다. 국민주권은 제1조 제2항, 법치국가는 제37조 제2항의 법률유보와 제107조의 위헌법률심판, 복지국가는 제34조와 제119조 제2항, 국제평화주의는 제5조와 제6조, 정당제도는 제8조, 지방자치는 제117조와 제118조에 근거합니다. 자료에는 문화국가 원리가 빠져 있으니 제9조와 함께 보충해 두면 좋습니다. 기본원리 사이의 긴장 관계, 예컨대 자유와 복지의 조화도 한 문단으로 덧붙이면 좋습니다.
